Litchfield Planning Board Minutes
March 19, 2007
1.0 Meeting convenes at 6:05 p.m. at Litchfield Town Office.
1.1 Members present: Judy Rogers (vice-chair), John Hatch, and Mike Seaman,
secretary Lezley Sturtevant and CEO Steve Ochmanski. Member Robert Gordon
absent, Eric Seaman (chair) and alternate Marvin Allen are excused.
2.0 Minutes of February 19, 2007 submitted for approval. Mike made a motion
to accept minutes as written. John 2nd the motion and vote 3-0-0.
3.0 Agenda Additions/Adjustments
5.1 Mailbox items - BOA/PB workshops to be held in Augusta, November 2007.
4.0 Scheduled Business
4.1 Land Use Ordinance - page 11 Non-Conforming Structures, Section 6, C, 1,
(A). This topic is remnant of last meeting; MMA has submitted input and the
requirements of this section should be considered disjunctively. Should the
Land Use Ordinance be amended to clarify, e.g. 'or' added. There are other
amendments to the LUO under discussion - mineral extraction (personal and
commercial differences), and change the definition of structure (add
exclusive of fences & subsurface wastewater disposal systems).
4.2 Shoreland Zoning Ordinance - How best to incorporate application review
from LUO, making the two ordinances more uniform. Sections 3, 4 & 5B in LUO
are the primary application requirement/review criteria. Steve O. has a
suggestion - the Comp Plan and LUO are used for the majority of land
management in town. Planned Development District was intended for business
development. There are currently 2 limited commercial zones covered by the
SZO in town: Rt 126 causeway, and Woodbury Park on Whippoorwill Road.
Limited commercial could be removed from the SZO; both existing businesses
would be grand fathered. The removal of limited commercial would eliminate
the need for Site Plan Review within the SZO. Steve O. has spoken with Rich
Baker (State of Maine SZ) agreed. If a marina were to be developed, it
would be allowed in limited residential with a PB review. Woodbury Park
could set back 250 feet to build a structure if necessary, or be rezoned.
The board discussed whether campgrounds would need a more in-depth review
than SZO provides for. They then consider adding the LUO performance
standards for lighting, and noise. Mike made motion to strike limited
commercial from page 9, 11, 12, 18, and any other found in editing. John
2nd the motion, and vote 3-0-0.
Eric had made some suggestions to Steve O. regarding adding to Section 15 -
Land Use Standards some items from the LUO, Section 8, G, J, M, and Section
9, D, & F. He would also like the SZO, Section 16, D - Procedure for
Administering Permits to include Section 4, A, 12, 13 & 15 of the LUO.
After further review the board decided to make the size limits on signs
uniform between the LUO and SZO. John made a motion to add to the Shoreland
Zone Ordinance, Section 15 the following from the Land Use Ordinance,
Section 8; G, J, M, and N. Mike 2nd the motion, and vote 3-0-0. John made
a motion to add from the Land Use Ordinance, Section 4, A, 3, 12, 13, & 15
to the Shoreland Zoning Ordinance, Section 16, D. Mike 2nd the motion, and
vote 3-0-0. Steve O. had a question proposed by Eric regarding traffic
flow/volume. Should Section R page 20 of the Subdivision Ordinance be added
to the SZO? Board decides to add a footnote to Section 14, Table 1 instead.
Footnote 13 will read - must meet Litchfield Road Ordinance to a Public
Way. Mike made a motion to add the footnote as written at the end of the
table and included on line 25, limited residential, line 29, stream
protection and limited residential, and line 35, limited residential in
Table 1. John 2nd the motion, and vote 3-0-0.
